(hereinafter \u201cAzemad Sport\u201d or \u201cSeller\u201d), with registered office at Rua Maria Concei\u00e7\u00e3o Santos, n.\u00ba 93, 3720-215 Oliveira de Azem\u00e9is, Portugal, registered with the Commercial Registry Office under the single registration and corporate taxpayer number 500 791 236 (VAT: PT500791236). Azemad Sport can be contacted by e-mail at <a href=\"mailto:sport@azemad.com\" target=\"_blank\" rel=\"noreferrer noopener\">sport@azemad.com<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-top:0px;padding-bottom:10px\">By using the Azemad Sport website, the user declares that they have read and accepted these Terms and Conditions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-top:0px;padding-bottom:0px\"><strong>Definitions<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Website:<\/strong> the website accessible at <a href=\"http:\/\/sport.azemad.com\/en\/\" target=\"_blank\" rel=\"noreferrer noopener\">www.sport.azemad.com<\/a>, where the products are available for purchase.<\/li>\n\n\n\n<li><strong>Consumer:<\/strong> a natural person who purchases products for non-professional use.<\/li>\n\n\n\n<li><strong>Professional Customer:<\/strong> a natural or legal person who purchases products in the course of their business, for resale or for their own use, and who is registered as such on the website. This includes shops, distributors, clubs, sports associations, schools, federations and public entities.<\/li>\n\n\n\n<li><strong>Customer:<\/strong> a term that covers both the Consumer and the Professional Customer. Where a clause applies to only one of them, this is expressly stated.<\/li>\n\n\n\n<li><strong>Seller:<\/strong> Azemad, Lda., represented by its legal representative, with whom the consumer or professional customer enters into the distance sales contract.<\/li>\n<\/ul>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\" \/>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<div style=\"height:0px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-top:0px;padding-bottom:10px\"><strong>2. ACCEPTANCE OF THE TERMS<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-bottom:10px\">By accessing or using our website, the Consumer\/Professional Customer agrees to fully comply with the Terms and Conditions set out in this document. If you do not agree with any of these provisions, we recommend that you do not continue browsing the website or make any purchases.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">By placing an order on our website, the Consumer\/Professional Customer expressly declares that they:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Are of legal age and have the legal capacity required to enter into sales contracts;<\/li>\n\n\n\n<li>Fully understand the general terms of sale described in this document and accept, without reservation, all the terms and conditions set out herein.<\/li>\n<\/ul>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\" \/>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-top:0px;padding-bottom:10px\"><strong>3. PURPOSE AND SCOPE OF THE TERMS<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The purpose of this website is the sale of roller hockey products to <strong>Consumers<\/strong> (personal use) and to <strong>Professional Customers<\/strong> (resale and professional use). These Terms and Conditions apply exclusively to purchases made online.<\/p>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\" \/>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-bottom:10px\"><strong>4. USER ACCOUNT CREATION AND PURCHASE PROCESS<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-bottom:10px\">To make a purchase on the <strong>Azemad Sport<\/strong> website, the Customer must create an account, providing valid and up-to-date personal data. The Customer is responsible for keeping their account and password confidential. <strong>Azemad Sport<\/strong> shall not be liable for unauthorised access to or misuse of the Customer\u2019s account that is not attributable to it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">All products available on our website are subject to stock availability. To add a product to the shopping cart, simply click <strong>\u201cAdd to Shopping Cart\u201d<\/strong> on the page of the desired item.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Consumers:<\/strong> before completing the order, the Consumer is shown the total price, including VAT and shipping costs. The purchase is deemed completed when the <strong>purchase confirmation<\/strong> page is displayed, after which an <strong>order confirmation<\/strong> e-mail is sent with all the details, including the items purchased and the total amount.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Professional Customers:<\/strong> after the request is submitted, a <strong>request confirmation<\/strong> e-mail is sent and, separately, a <strong>quotation<\/strong> including the shipping costs, calculated on the basis of the destination and the weight and dimensions of the package(s). The order is only deemed completed once the quotation has been accepted by the Professional Customer. If you do not agree with the quotation, simply do not accept it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-bottom:10px\">The Customer may view the details of their order at any time through their account on <strong>Azemad Sport<\/strong>. All data provided during the purchase process is handled securely and confidentially, in accordance with our <strong><a href=\"https:\/\/sport.azemad.com\/en\/privacy-policy\/\" data-type=\"link\" data-id=\"https:\/\/sport.azemad.com\/en\/privacy-policy\/\" target=\"_blank\" rel=\"noreferrer noopener\">Privacy Policy<\/a><\/strong>.<\/p>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\" \/>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-bottom:10px\"><strong>5. PRICES AND PAYMENTS<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-bottom:10px\">The prices shown on the website are expressed in euros and include VAT at the applicable legal rate. Shipping costs are added to the prices shown. Any other applicable taxes or duties must be paid by the Customer at the customs of the destination country. Customers located outside Portugal should find out about any import duties or taxes that may apply to their orders, and are responsible for declaring and paying them.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-bottom:10px\">As a result of exchange rate fluctuations, adjustments in transport and material costs, among other factors, prices may be subject to change, and Azemad Sport reserves the right to modify them without prior notice. Price changes do not apply to orders that have already been completed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-bottom:10px\"><strong>Payment method:<\/strong><br>Orders from <strong>Consumers<\/strong> are paid in advance, at the time of purchase, by one of the following methods: bank card, MB Way or Multibanco Reference. The order is only processed once payment has been confirmed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-bottom:10px\">Orders from <strong>Professional Customers<\/strong> are paid after Azemad Sport has received the request and the Professional Customer has accepted the corresponding quotation, which includes shipping costs. When payment is made by bank transfer, proof of payment must be sent to <a href=\"mailto:sport@azemad.com\" target=\"_blank\" rel=\"noreferrer noopener\">sport@azemad.com<\/a>, stating the order number.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-bottom:10px\"><strong>Product Unavailability:<\/strong><br>If the ordered product is out of stock or unavailable, Azemad Sport will inform the Customer, who may choose either a refund of the amount paid or replacement with another product.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-bottom:10px\"><strong>Payment Costs:<\/strong><br>Any costs associated with payment, such as bank transfer fees, are the responsibility of the Customer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Invoices and Receipts:<\/strong><br>Once the order has been placed, an <strong>invoice<\/strong> will be sent to the e-mail address provided during the purchase process, issued with the details of the transaction. Once payment has been confirmed, the <strong>receipt<\/strong> for the invoice amount will also be sent.<\/p>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\" \/>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-bottom:10px\"><strong>6. SHIPPING AND DELIVERY<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-bottom:10px\"><strong>Azemad Sport<\/strong> ships products worldwide. Shipping times are set by the transport services selected during the purchase process and are subject to the conditions of those third parties. Further information on delivery times and conditions can be found when choosing the shipping method.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-bottom:10px\"><strong><a>Liability during transport<br><\/a><\/strong>For Consumer orders, unless another period has been agreed, delivery takes place within a maximum of 30 days of the conclusion of the contract, and Azemad Sport is liable for loss of or damage to the products until the Consumer, or a person designated by them other than the carrier, receives them. For Professional Customer orders, Azemad Sport cannot be held liable for loss of or damage to the products from the moment they are handed over to the carrier<strong>.<\/strong><br><\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-bottom:10px\"><strong>Checking the packaging<\/strong><br>We recommend that the Consumer check the packaging upon delivery. If there is visible damage, they should:<br>1) record it with the carrier; and<br>2) inform Azemad Sport, with photographs, within 48 hours.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-bottom:10px\">For Consumers, this notification serves only to help resolve the problem and does not affect their statutory rights.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-bottom:10px\"><strong>Receipt of the order<\/strong><br>The order is delivered by the carrier to the address provided by the Consumer. The Consumer must ensure that they, or someone on their behalf, are present to receive it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-bottom:10px\"><strong>Recipient not present<\/strong><br>If no one is available to receive the order, the carrier may make another delivery attempt or leave it at a nearby collection point, leaving a notice for the Consumer. In that case, the Consumer is responsible for collecting the order from the collection point within the period indicated by the carrier.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-bottom:10px\"><strong>Uncollected orders<\/strong><br>If the order is not collected within that period and is returned to Azemad Sport, Azemad Sport will contact the Consumer, who may choose between:<br>a) a new shipment, paying the corresponding shipping costs; or<br>b) cancellation of the order, with a refund of the amount paid, less the shipping and return costs actually incurred by Azemad Sport.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-bottom:10px\">If the Consumer does not respond within 15 days, the order will be cancelled under point b).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Shipping costs:<\/strong><br>For Consumers, shipping costs are shown before the order is completed. For Professional Customers, shipping costs are communicated by means of a quotation sent by e-mail after the request is received. Shipping costs are the responsibility of the Customer.<\/p>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\" \/>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-bottom:10px\"><strong>7. RETURNS, CANCELLATIONS AND EXCHANGES<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-bottom:10px\"><a><strong>Consumer returns:<\/strong><\/a> the Consumer may return the products, without giving any reason, within 14 days of receiving them (right of withdrawal). To do so, simply send, within that period, an unequivocal statement to <a href=\"mailto:sport@azemad.com\">sport@azemad.com<\/a> or by letter to the registered office, using, if desired, the attached form, which is not mandatory.<br>The products must be returned within 14 days of that notification, with the cost of return borne by the Consumer. The Consumer may examine the products and is only liable for any diminished value resulting from handling beyond that. This right does not apply to products that are personalised or made to the Consumer\u2019s specifications.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Consumer refunds:<\/strong> in the event of withdrawal, Azemad Sport will refund the Consumer all payments received, including shipping costs, within 14 days of the date on which it receives the notice of withdrawal. If the Consumer has expressly chosen a more expensive shipping method than the cheapest standard method available at the time of purchase, the difference in cost between the two will not be refunded.<br>The refund is made using the same means of payment used for the purchase, unless expressly agreed otherwise, at no cost to the Consumer. Azemad Sport may withhold the refund until it has received the returned products or until the Consumer has provided proof of having sent them, whichever occurs first. If, upon receipt, Azemad Sport finds that the products have lost value due to handling beyond what is necessary to examine them, it may deduct that amount from the refund.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Professional Customer returns:<\/strong> returns of products purchased by Professional Customers are only accepted with the prior written agreement of Azemad Sport, under the conditions then agreed between the parties. Unless otherwise agreed, returned products must be in perfect condition, show no signs of use and be in their original packaging, and the return costs are borne by the Professional Customer. This paragraph is without prejudice to the Professional Customer\u2019s rights in the event of a defective product or a product that does not conform to the order.<\/p>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\" \/>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-bottom:10px\"><strong>8. WARRANTIES AND AFTER-SALES SERVICE<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-bottom:10px\"><a><strong>Consumers:<\/strong><\/a> products benefit from the 3-year legal guarantee from delivery, under Decree-Law no. 84\/2021. In the event of a lack of conformity, the Consumer is entitled to have the product repaired or replaced and, in the cases provided for by law, to a price reduction or termination of the contract.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-bottom:10px\"><strong>Professional Customers:<\/strong> Azemad Sport offers a 2-year warranty against manufacturing defects, applicable only to the repair or replacement of the defective part, and not valid for replacement of the complete product.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Specific equipment:<\/strong> products such as <strong>wooden sticks and balls<\/strong> are subject to wear and breakage resulting from normal use in sport. The warranty covers manufacturing defects, but does not cover damage caused by misuse, accidents or impacts outside normal use, without prejudice to the Consumer\u2019s statutory rights.<\/p>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\" \/>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-bottom:10px\"><strong>9. INTELLECTUAL PROPERTY RIGHTS<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The content of the website, including text, images, logos and design, is protected by <strong>copyright<\/strong> and belongs to <strong>AZEMAD, Lda.<\/strong> Unauthorised use of this content is prohibited.<\/p>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\" \/>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-bottom:10px\"><strong>10. DATA PROTECTION AND PRIVACY<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Azemad Sport<\/strong> is committed to protecting the privacy of its Customers, processing personal data in accordance with the <strong><a href=\"https:\/\/sport.azemad.com\/en\/privacy-policy\/\" data-type=\"link\" data-id=\"https:\/\/sport.azemad.com\/en\/privacy-policy\/\">Privacy Policy<\/a><\/strong> available on the website.<\/p>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\" \/>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-bottom:10px\"><strong>11. Changes apply only to orders placed after their publication on the website. Each order is governed by the version in force on the date it was placed.<\/p>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\" \/>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-bottom:10px\"><strong>13. DISPUTE RESOLUTION AND JURISDICTION<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-bottom:10px\"><strong>Consumers<\/strong> <a><br>In the event of a consumer dispute, the Consumer may file a complaint in the Electronic Complaints Book at<\/a> <a href=\"http:\/\/www.livroreclamacoes.pt\" target=\"_blank\" rel=\"noreferrer noopener\">www.livroreclamacoes.pt<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Consumer may also refer the matter to an Alternative Consumer Dispute Resolution (ADR) entity. Further information on the available ADR entities can be found on the Consumer Portal at <a href=\"http:\/\/www.consumidor.gov.pt\" target=\"_blank\" rel=\"noreferrer noopener\">www.consumidor.gov.pt<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Contracts entered into with Consumers are governed by Portuguese law, without prejudice to any more favourable mandatory provisions of the law of the Consumer\u2019s country of habitual residence. The Consumer may bring proceedings before the courts of their place of residence or before the Portuguese courts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Consumers residing in another Member State may obtain free assistance in resolving cross-border disputes from the European Consumer Centre in their country (ECC-Net).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-bottom:10px\"><strong>Professional Customers<\/strong><br>Contracts entered into with Professional Customers are governed by Portuguese law.
